به گزارش راه مردم به نقل از «تابناک»، در روزهای اخیر، دانشگاه کلدونیان گلاسکو اسکاتلند، چکیده پایان نامه رئیس جمهور ایران در مقاطع کارشناسی ارشد و دکترا را منتشر کرده که به قابلیت کاربرد حقوق اسلامی در سیاست مدرن در چهارچوب تفاسیر نسبتا منعطف از شریعت اختصاص دارد. روحانی که مذاکره کننده ارشد هستهای ایران بوده، این روزها به علت سابقه تحصیل در غرب و تفاوتهایش با محمود احمدینژاد، رئیس جمهور کنونی ایران مورد توجه رسانهها قرار گرفته است.
اما ماجرا از آنجا آغاز شد که یک وبسایت فارسی خارج از ایران مدعی شد که به نظر میرسد یک پاراگراف از رساله دکترای رئیس جمهور جدید ایران، از یک کتاب نوشته شده توسط محمد هاشم کمالی، حقوقدان برجسته افغانی برداشته شده که اکنون مدیر و بنیانگذار مؤسسه بینالمللی مطالعات پیشرفته اسلامی در مالزی است.
در پاراگرافی از نسخه پیدیاف کتاب آقای کمالی که در سال 1991 منتشر شده و اکنون به چاپ سوم رسیده، آمده است:
"This style of Qur'anic legislation, and the fact that it leaves room for flexibility in the evaluation of its injunctions, is once again in harmony with the timeless validity of its laws.The Qur'an is not specific on the precise value of its injunctions, and it leaves open the possibility that a command in the Qur'anmay sometimes imply an obligation, a recommendation or a mere permissibility."
در یک صفحه پیش از این هم آمده است:
As a characteristic feature of Qur'anic legislation, it may be stated here that commands and prohibitions in the Qur'an are expressed in a variety of forms which are often open to interpretation and ijtihad.
همچنین در پاراگراف مربوطه در رساله دکترای آقای روحانی که در جولای 1998 و با نام «انعطافپذیری شریعت با توجه به تجربه ایران» نوشته شده، آمده است:
"The primary source of the Islamic law (the Quran) is, in itself, flexible on the basis of the analysis that the Quranic legislation leaves room for flexibility in the evaluation of its injunctions. The Quranis not specific on the precise value of its injunctions, and it leaves open the possibility that a command in the Quranmay sometimes imply an obligation, a recommendation or a mere permissibility. Commands and prohibitions in the Quran are expressed in a variety of forms which are often open to interpretation.
